Terms of Use

This is a legally binding agreement outlining the terms and conditions for using all services provided by InfozySMS (infozysms.com). By accessing or using our services, you agree to comply with these terms. This agreement is governed by the laws of the Government of India.

Please read these terms carefully. All notices under this agreement are considered delivered and accepted once electronically confirmed.

Service Usage Policy

You agree to comply with all applicable local, national, and international laws and regulations. You are solely responsible for any activities conducted through your account, including the content of messages sent using our services.

The SMS services provided by InfozySMS are subject to the following conditions:

• Any illegal use of the service is strictly prohibited.
• Messages containing sexual, offensive, discriminatory, or harassing content are forbidden. You will be held fully responsible for any such messages you send.
• InfozySMS assumes no liability for the content of messages transmitted through your account.
• You guarantee that the content of your messages respects fundamental human rights and intellectual property laws.
• You agree not to use the service to:
  • Promote alcohol, gambling, dating, or deceptive offers.
  • Send unsolicited messages (spam).
  • Collect information about others without consent.
  • Mislead recipients about your identity or impersonate others.
  • Share any material that is unlawful, abusive, vulgar, or otherwise objectionable.
  • Infringe on intellectual property rights.
  • Transmit any harmful software or viruses.
  • Interfere with networks or attempt unauthorized access.
  • Engage in activities that could result in criminal or civil liability for InfozySMS.

You acknowledge that SMS delivery relies on telecom operators and is subject to their technical constraints. Successful delivery depends on factors including the recipient’s network coverage, phone status, and memory availability.

You are responsible for keeping your login credentials secure. All activities under your account are your responsibility.

InfozySMS does not guarantee the availability, performance, or error-free operation of the service. We make every effort to deliver messages promptly, but credits are not refundable for undelivered messages as delivery cannot be guaranteed.

Transmission logs maintained by InfozySMS are considered accurate records of message delivery.

InfozySMS reserves the right to suspend or terminate your access to the service at its discretion. Remaining account balances will be refunded only if applicable under our no-refund policy.

Credits in your SMS account are non-refundable and do not accrue interest. All credits must be used within the validity period specified at purchase.

You are fully responsible for the messages sent through your account. You agree to indemnify InfozySMS against any claims, damages, or losses arising from your breach of these terms.

Limitation of Liability

While we will take all reasonable steps to deliver your messages as quickly as possible, we cannot guarantee a specific delivery time. Message delivery depends on several network factors beyond our control.

Delivery reports and sender ID availability are operator-dependent features and cannot be guaranteed.

SMS that cannot be delivered within their allotted lifespan will be discarded by the Mobile Network Operator without notice. We are not responsible for any losses due to failed deliveries.

You acknowledge that SMS messages are transmitted unencrypted and may be intercepted by third parties. We recommend using multiple channels for sharing sensitive information.

The service is provided "as is" and "as available", without warranties of any kind, expressed or implied. Your use of the service and the internet is at your own risk.

InfozySMS, its affiliates, agents, content providers, and service providers disclaim all warranties regarding:

• The accuracy, completeness, or suitability of the service or any content.
• The uninterrupted or error-free operation of the service.

We shall not be liable for:

• Errors, omissions, or losses caused by service delays or interruptions.
• Any direct, indirect, or consequential damages arising from your use or inability to use the service.

You agree to indemnify InfozySMS against any third-party claims related to your use of the service. These provisions benefit InfozySMS and its partners, who may enforce them directly.

Modification of Terms

InfozySMS reserves the right to update or change these terms at any time as necessary to improve or maintain the service. If you disagree with any changes, you may cancel your account according to our cancellation policy.

You are responsible for reviewing these terms regularly. Upon request, we can notify you of any updates.

If any specific terms and conditions conflict with these general terms, the specific terms shall apply.

Termination

If you breach these terms, we reserve the right to suspend or terminate your account and recover any damages arising from your actions.

Suspension or termination does not release you from obligations already accrued. All payments and responsibilities under this agreement remain in effect during suspension or after termination.

Upon termination, you must stop using the service immediately. We are not obligated to retain your account or any associated credits.

You may also terminate this agreement at any time by sending us written notice via email. Upon termination, you will lose access to any remaining credits, and all your responsibilities under this agreement remain in effect for the period you used the service.

These terms are subject to change in accordance with TRAI rules and regulations.
